电子商务模式选择错误是我国电子商务发展过程中存在的突出问题，如传统的“千店一面”的格局，在电子商务和网络零售中反映出来，表现为“千网一面”。在电子商务模式的探讨中仍然存在很多的理论误区，如网店的“百货店”趋势、网上团购中同质化导致的“千团消失”、大宗商品电子化交易中的300多家“泡沫”、家电网购变幻莫测的“价格战”、网上购物网下消费“理想的”020模式面临“危机”以及电子商务法律滞后，至今我国还没有一部全国性的、综合性的电子商务法规，现有电子商务部门法规政出多门，相互不统一，电子商务标准越来越多，但越来越跟不上科学与技术发展的需要，“三网融合”（宽带电信网、新一代互联网、数字电视网相互融合）以及物联网融合面临着许多的问题，很难做到“无缝连接”。

Author Description

洪勇，1983年出生，北京工商大学物流专业学士、管理学硕士，中国社会科学院研究生院2010级产业经济学博士研究生。2004-2010年在中国物流与采购联合会采购专业委员会工作，曾参与北京市商委的《中国城市电子商务影响力》等课题，以及中央电大《电子商务概论》的编写，参与了阿里巴巴“百佳网商评比”调研活动并撰文，在《餐饮蓝皮书》、《中国市场》、《中国外资》、《餐饮世界》、《经贸参考》等刊物上发表论文多篇。

（二）经济法律体系不健全，执法环境权威性欠佳目前，国内有关法律法规对网上交易的权利和义务规定不清晰，缺乏网络消费和服务权益保护管理规则，没有专门的法律来规范网络银行的经营和使用。特别是在客户信息披露和隐私权保护方面，还缺乏比较成熟的经验，在出现争端时，责任的认定、划分、仲裁结果的执行等法律问题在现有法律框架下难以解决。
另外，中国网络银行的信息跟踪、检测、信息报告交流制度的相关法律规则都未建立，在利用网络签订经济合同、提供金融服务和保护银行与客户双方权利的过程中存在诸多尚待改进之处。如网络提供商的侵权行为。
（1）互联网服务提供商的侵权行为：①ISP具有主观故意（直接故意或间接故意），直接侵害用户的隐私权。②ISP对他人在网站上发表侵权信息应承担责任。
（2）互联网内容提供商的侵权行为。ICP是通过建立网站向广大用户提供信息，如果ICP发现明显地公开宣扬他人隐私的言论，采取放纵的态度任其扩散，ICP构成侵害用户隐私权，应当承担过错责任。
（3）由于电子现金可以实现跨国交易，税收和洗钱将成为潜在的问题。现在，通过互联网进行跨国交易时的国际税收问题已经发生，将来会更加突出，为了解决这个问题，流通时不会留下任何记录，税务部门很难追查，所以即使将来调整了国际税收问题，由于不可跟踪性，电子现金很可能被不法分子所利用，使逃税和洗钱变得很容易。因为利用电子现金可以将钱送到世界上的任何地方而不留痕迹，如果调查机关想要获取证据，需要检查网上所有的数据并破译所有的密码，这几乎是不可能的。
